EU Port Strategy: Establishing a State Aid Framework to Enhance Competitiveness and Achieve Objectives

The EU Port Strategy is in need of a comprehensive State Aid Framework designed to enhance the competitiveness of the port sector and support the attainment of EU objectives. During the mid-year General Assembly in Naples, FEPORT members celebrated a significant milestone.

On April 28, 2025, the European Court of Justice issued an order stating that FEPORT’s advocacy influenced the EU Commission to address its inaction over the 2015 Greek Tonnage Tax Decision, which had remained unresolved for nine years. FEPORT’s persistence has led to the publication of two crucial decisions that clarify the eligibility and scope of the tonnage tax scheme, aligning it with the Maritime State Aid Guidelines and BEPS Pillar 2 definition regarding international shipping.

Notably, the regulations specify that the revenue generated from cargo handling in ports applies only to integrated operations. In practice, this means shipping lines cannot claim tonnage tax for handling containers for third parties within the port area.

In discussions about the EU Port Strategy, FEPORT members noted the need for a focus on competitiveness rather than solely on defensive measures. Establishing a robust, competitive, and resilient port industry is essential, particularly as EU ports face significant pressure from their non-EU counterparts in terms of service offerings, bunkering, and alternative fuels.

Mr. Gunther Bonz, President of FEPORT, emphasized the necessity of a clear and ambitious State Aid framework that recognizes the “glocal” dynamics of the industry, allowing stakeholders to remain competitive. FEPORT advocates for an EU State aid framework that outlines various funding mechanisms and compensation measures to empower member states in boosting the port sector’s competitiveness against international challenges.

Such a framework would create predictable and transparent regulations that minimize legal risks, promote fairness, and encourage sustainable investment aligned with EU goals. It is particularly crucial in the context of military mobility, facilitating investments in critical infrastructure.

FEPORT and its members are keen to collaborate with the EU Commission to contribute valuable insights into the EU Port Strategy’s development.
